1. Your purchase guarantees with ascopharm

Our prices include VAT and will remain valid until new prices are announced. To the best of our knowledge and belief, the prices quoted are correct. However, should a mistake occur (e.g., a typographical or clerical error), we reserve the right to charge the correct price. In such an event, you will, of course, have an immediate right of withdrawal, should you not agree.

4. Minimum order value

The minimum order value is EUR 15.00. ascopharm customers only pay EUR 3.80 for the costs of shipping and packing. From an order value of EUR 35.00 we deliver free of charge within Germany.

5. Deliveries

ascopharm delivers immediately (subject to our own supply) and without long waiting times. All shipments are packed in such a way that they are protected from breaking. However, should any transport damage occur, please report it immediately to your local post office.

6. Offer and conclusion of contract

6.1 The presentation of products in our online shop does not constitute a legally binding offer but rather an invitation to place an order. Errors excepted.
6.2 By clicking on the [Buy now] button, you will place a binding order of the goods listed on the order page. The contract is considered as concluded as soon as we confirm your order with an order confirmation via e-mail, as soon as we have received your order.

7. Instructions concerning cancellation

Cancellation rights

You may cancel the contract within 14 days without giving any reasons, in writing (e.g. letter, fax, e-mail), or – if the item is handed over to you prior to the end of the cancellation period – by returning the item. The cancellation period shall begin upon receipt of these instructions, albeit not before receipt of the goods by the recipient (in the case of repeat deliveries of similar goods, not before receipt of the first partial delivery), nor before we fulfil our duty of providing information pursuant to article 246 § 2in conjunction with § 1 sections 1 and 2 Introductory Act to the German Civil Code (EGBGB) as well as our duties pursuant to § 312g section 1 clause 1 German Civil Code (BGB) in conjunction with article 246 § 3 Introductory Act to the German Civil Code (EGBGB). The cancellation period is sufficiently long to post the cancellation notice or the item in good time. The cancellation must be sent to:

Consequences of cancellation

In the event of effective cancellation, the goods or services received by either party shall be returned, and any benefits that may have been accrued (e.g. interest) shall be released. Should you be unable to return the goods or services and the uses obtained from them (e.g. benefits of use) in full or in part, or in their original condition, you will be liable to pay us appropriate compensation. You will only have to pay us compensation for the deterioration of goods and for uses obtained from them if that deterioration can be attributed to you using the goods beyond verifying the characteristics and functionality of the product. “Verifying the characteristics and functionality of the product” means testing and trying the product in question, as is possible and customary at the point of sale. Items that can be sent in a parcel must be returned to us at our own risk. You will have to bear the regular return costs when the goods delivered correspond to the goods ordered and the value of the items to be returned does not exceed 40 euros, or, if the value of the items is higher, when your compensation payment is still outstanding at the time of cancellation, or when you have paid an instalment as agreed in the contract. Otherwise, you can return the goods free of charge. Items which cannot be sent as a parcel will be collected at your premises. In such a case, please call us. We will organise for the goods to be collected at an address of your choice. Compensation payment obligations must be fulfilled within 30 days. The cancellation period starts for you upon sending the cancellation request or posting the item, and for us, upon their receipt.

8. Return costs when making use of your cancellation rights

If you make use of your statutory cancellation rights (see “Instructions concerning cancellation”), you will have to bear the regular return costs when the goods delivered correspond to the goods ordered and the value of the items to be returned does not exceed 40 euros, or, if the value of the items is higher, when your compensation payment is still outstanding at the time of cancellation, or when you have paid an instalment as agreed in the contract. 9. Overseas deliveries

For a delivery in the value of over EUR 75,00 we will take a proportional takeover of shipping costs of EUR 4,00; from a commodity value of EUR 150,00 we will take a proportional takeover of shipping costs of EUR 8,00. Orders with a value below EUR 75.00 are only possible when take full shipping costs. The proportional takeover of the shipping costs is only available with a customer account.

Overseas deliveries are only possible when the full postage costs are borne. Any fees charged for bank transfers must be borne by you as the client. For cash-on-delivery orders to be delivered to a country within zone 2 or beyond, a surcharge of EUR 6.00 will become due in addition to the cash-on-delivery costs of EUR 3.60 plus postage. Generally, VAT is charged on all shipments within the EU. Unless you have a VAT identification number, you will be charged VAT. VAT-exempt deliveries to non-EU countries are only possible if the shipping address is also in that country. Unfortunately, it will not be possible to refund VAT at a later date.

The shipping costs for overseas deliveries depend on the stated delivery address and the weight of the goods selected. For further information, please see the Overview of weight-related costs by zone. We will inform you of the actual shipping costs prior to delivery.

Other costs and any possible taxes shall be borne by the customer.

 Payments within the EU:
For bank transfers, please use the EU standard bank transfer form, stating the IBAN and BIC numbers (which can also be found on the invoice) in order to avoid additional charges.

Payments outside the EU:
Any fees charged for bank transfers must be borne by you as the client.

10. Payments

ascopharm customers can choose to pay on account in full within 14 days of receipt of the invoice, via direct debit and advance payment with a 3% discount, and via credit card, Paypal and cash on delivery. The customer shall guarantee that sufficient funds are available in the bank account specified. If the order is “cash on delivery”, the charges for this service of currently EUR 3.60 shall be borne by the recipient. In individual cases, ascopharm GmbH reserves the right to reject particular payment methods.

When paying cash on delivery, an additional charge of EUR 3.60 as well as a transfer fee in the amount of EUR 2.00 will become due, which are payable to the person delivering your order upon delivery.

When paying via direct debit, your account will be charged 4-5 days after the goods have been delivered.

12. Title retention

All goods delivered remain the property of ascopharm GmbH, Wernigerode, Germany, until payment has been made in full.
